Agreement
By downloading or using Earthquake Alerts (the "App"), you agree to these Terms. If you do not agree, do not use the App.
The App is provided free of charge by AppTune LLC ("we", "us"). It shows recent earthquakes reported by public seismic agencies on a map and can send push notifications about earthquakes near a location you choose. Our Privacy Policy explains how we handle data.
Not an emergency or early-warning service
The App is for general information only. It is not an earthquake early-warning system, and you must not rely on it for your safety.
- Alerts are sent only after an agency has published an earthquake, usually minutes after it occurred, and often after shaking has already ended.
- Alerts may be delayed, inaccurate, incomplete, or never delivered, due to agency delays, revised magnitudes or locations, network outages, device settings, or push-service failures.
- Magnitudes and locations are provisional and may change or be withdrawn.
- The App does not replace official warnings. Always follow your government, civil-defense agency, and local emergency services, and call your local emergency number if you are in danger.
Data sources and attribution
Earthquake data comes from third-party agencies, including USGS, EMSC, JMA, GEOFON, GeoNet, AFAD, CWA, and CENC. We do not create, verify, or control this data and are not responsible for its accuracy or availability.
Map data is based on OpenStreetMap and other open datasets, and city names come from GeoNames. Each source remains subject to its own license. Full notices are listed under Licenses in the App's settings.
Acceptable use
You may use the App for personal, non-commercial purposes. You agree not to:
- Scrape, bulk-download, or resell data from our API or map tile servers.
- Overload, disrupt, or attempt unauthorized access to our services.
- Reverse engineer the App except where the law allows it.
- Use the App in violation of any law.
Intellectual property
The App's design, code, and branding belong to us. Third-party data remains the property of its owners under their licenses. These Terms grant you a limited, revocable, non-transferable license to use the App on devices you own or control, subject to the Apple App Store and Google Play terms that apply to your download.
Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR ITS ALERTS WILL BE TIMELY, UNINTERRUPTED, OR ERROR-FREE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, LOSS OF LIFE, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF OR RELIANCE ON THE APP, INCLUDING A MISSED, LATE, OR INACCURATE ALERT. OUR TOTAL LIABILITY IS LIMITED TO USD 50. Some jurisdictions do not allow these limits, so they may not fully apply to you. Nothing here limits rights you have under mandatory consumer law.
Termination
You can stop using the App at any time by uninstalling it. We may change, suspend, or discontinue the App or any feature at any time without notice.
Governing law
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [VENUE], unless mandatory law in your country of residence says otherwise.
Changes to these Terms
We may update these Terms by posting a new version on this page and updating the effective date. Continuing to use the App after a change means you accept it.
